TERMS AND CONDITIONS

These are the terms and conditions for the Boursin® ‘Bed & Boursin’ competition running from 6th September 2021 – 17th September 2021.

There are two mid-week stays and three weekend stays to be won in total.

Each stay is for one competition winner plus seven guests.

The competition is organised by Bel UK, a private limited company, based 160 London Road, Sevenoaks, Kent, TN13 2JA (hereinafter the “Organising Body”). The private limited company Popcorn PR, based R2 Rapide Studios, De Havilland Court, Penn Street, Bucks, HP7 OPX, +44 (0)1494 413170, is the promoter of the competition (hereinafter the “Promoter”).

How to enter:

Entry is free. To enter, upload a grid post image of your most creative recipe with a Boursin twist to Instagram. Recipes must be original content.

A ‘Boursin twist’ constitutes a photo that shows a creative or unique use of Boursin in a culinary dish.

In order for an entry to be valid, the following criteria must be met:

The post image must comply with the conditions of participation of the competition.

Posts must include #BedAndBoursin

Posts shared on Instagram must tag @boursinuk

Each person may submit as many entries as they wish. Each eligible post will be entered into the competition for consideration by the judging panel

Entry is open to UK residents only and travel is not included.

As a reminder, the competition is in no way managed or sponsored by Instagram, which has no responsibility in the context of its organisation and vis-à-vis Internet users. The personal data collected as part of the operation is not intended for Instagram but for the Organising Body.

Winning entrants agree that the image or content submitted may be used across Boursin social media (Twitter, Facebook, Instagram) and website (Boursin.co.uk) in relation to the Boursin “Bed & Boursin” competition and for duration of the campaign only (6th September – 4th October 2021) unless permission is given to extend this usage

The prize:

The prize consists of five stays at the luxury Bed & Boursin in Suffolk, exact location and accommodation details will be provided once winners are announced.

Each stay is provided for 8 guests and includes:

  • 2 nights and 1 day at the Bed & Boursin location
  • Welcome drinks and grazing board upon arrival
  • 1 dinner on the second evening, elaborated with Boursin products. The dinner will be prepared by a local private chef, who will involve the participants in the making of certain dishes in the context of a “cook-along class”
  • Ingredients at guests’ disposal to prepare their breakfast and brunch

Every other expense which is not indicated in these terms and conditions will not be covered by Bel UK and will thus be at the winners’ own expense. In particular they must pay for the travel expenses and for all meals that are not included.

Upon accepting the prize, winners must declare any allergies so they can be catered for appropriately over the weekend. Bel UK cannot be held responsible for any adverse reactions when allergies have not been disclosed in advance.

Check in time at the property is 4pm and check out time is 10am.

Fixed dates are as follows and winners must be available on these dates:

  • Friday 17th September 2021 – Sunday 19th September 2021
  • Tuesday 21st September 2021 – Thursday 23rd September 2021
  • Friday 24th September 2021 – Sunday 26th September 2021
  • Tuesday 28th September 2021 – Thursday 30th September 2021
  • Friday 1st October 2021 – Sunday 3rd October 2021

The prize is not transferable and there is no cash alternative.

Covid requirements

All winners must comply with the safety and health measures applicable during their stay. In particular, winners commit to respect the sanitary measures put in place by the UK government in the context of the Covid-19 pandemic, including, but not limited to, social distancing, the frequent washing of their hands with soap or hydroalcoholic gel, wearing of a facemask when required. Winners may be required to scan a QR code upon arrival with the application “track and trace”, in order to register their presence at the location and be alerted in case of the declaration of a Covid case.

All winners commit to refuse the prize if they have tested positive to Covid-19 in the last 10 days, if they have presented symptoms of Covid-19 in the last 48 hours before the stay, or if they have been in contact with a person tested positive to Covid-19 in the last 14 days before the stay.

If the winner refuses the prize in a reasonable time before the stay, another winner will be selected.

Entry period

The competition will open on 6th September 2021.

There will be two draws for the five prizes.

Draw 1 for the below stays:

  • Friday 17th September 2021 – Sunday 19th September 2021 for winner 1
  • Tuesday 21st September 2021 – Thursday 23rd September 2021 for winner 2

Draw 1 will close at midnight 10th September 2021 and winners will be contacted by email/phone within 24 hours (11thSeptember 2021).

Draw 2 for the below stays:

  • Friday 24th September 2021 – Sunday 26th September 2021 for winner 3
  • Tuesday 28th September 2021 – Thursday 30th September 2021 for winner 4
  • Friday 1st October 2021 – Sunday 3rd October 2021 for winner 5

Draw 2 will close on midnight 17th September 2021 and winners will be contacted by email/phone within 24 hours (18thSeptember 2021)

Entries received after midnight 17th September will not be eligible.

Winner selection:

Five winners will be selected, each winning a stay for them and seven guests maximum at Bed & Boursin.

Each eligible post will be entered into the competition for consideration by a judging panel composed of employees of the Promoter and the winner will be eventually selected by an independent chef within the promoter’s employees. Winners’ selection will be based on the most creative entries.

Members of the jury must not be linked to any of the selected winners to avoid any conflict of interest.

Winners will be contacted by the dates stated above by a representative by telephone and/or email.

Winners have 24 hours from initial notification to confirm acceptance of their prize, otherwise the judging panel will select another winner.

Any employees of BEL UK, its subsidiaries and/or affiliated companies, service providers and/or partners in the creation of the Bed & Boursin competition cannot be selected as a winner.

Eligibility Criteria:

Entrants must be 18+ years old to enter and entries must be UK only.

The winner and their seven guests at Bed & Boursin must sign a disclaimer in order to stay at Bed & Boursin to state they are liable for any damage or losses to the property and its contents due to misuse or misdemeanour.

Any material deemed inappropriate, incomplete, incorrect or unsuitable, in Boursin’s sole discretion will be disqualified. Boursin also reserve the right to report any content or social media users deemed to be sharing inappropriate or unsuitable materials (see below).

Content will not be published that allows identification of people (name, visible address, contact details).

By entering content to enter this competition and uploading material, you confirm that the material submitted is your own or that you have the written consent of the owner to publish this material.

Entrants guarantee BEL against any recourse, action or claim that may be brought by any third party, in any capacity whatsoever, in connection with the exercise of the rights assigned and, more generally, in respect of all guarantees and commitments made. Any Entrant acknowledges being the author of the photos and/or videos or holding the exploitation rights on the photos and/or videos.

Inappropriate and unsuitable Material includes, but is not limited to:

pornographic or inappropriate material,

material of a defamatory, insulting, slanderous, xenophobic, negationist, racist, sexist, of a hateful nature or which more broadly undermines human or animal dignity, or which denigrates third parties, natural or legal persons, and in particular BEL’s products or brands,

material of a discriminatory or violent nature against a person or a group of persons because of their origin, their membership or non-membership, real or assumed, of a specific ethnic group, nation, race, sexual orientation, profession, age group or religion

material making the apology of the crimes of voluntary attacks with the life, the integrity of the person and the sexual aggressions defined by the book II of the criminal code (rape, attack with the indecency, public insult, attack with the manners, sexual harassment…).

material defending terrorism, war crimes, crimes against humanity or crimes or offences of any kind;

political content or propaganda,

obscene, sexual, profane, lewd, or otherwise offensive material,

material that is deemed dangerous or where health and safety is in question

nudity

car licence plates, phone numbers or personal addresses

website or web page links,

any third-party materials that may otherwise violate or infringe (or may infringe) copyright, trademark, logo, mark that identifies a brand or other proprietary right of any person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity, or is otherwise objectionable,

any material that infringes or violates someone else’s rights or the law,

any content or performance that has been broadcast or streamed, published, or televised on television or as part of a recording of a motion picture film or television programme

material defaming or invading publicity rights or privacy rights of any person, living or deceased, or otherwise infringing upon any person’s personal or proprietary rights

material of an advertising, promotional or commercial nature for a product/brand other than those held by BEL,

breach of generally accepted standards of netiquette or norms of the internet community

Use of information:

The participant’s personal data is collected from the Instagram grid post image and processed by the Organising Body, acting in this context as the Data Controller within the meaning of the applicable legislation on the protection of personal data.

The personal data collected are thus processed for the purposes of:

  • managing registration and participation in the competition and drawing the winning prizes, on the basis of the participant’s acceptance of the competition terms and conditions; and
  • where applicable, send the participant newsletters and/or promotional offers, based on his/her consent to receive communications from the Organising Body.

In the context of the organisation of the competition, the Organising Body may transfer the participant’s personal data to technical service providers such as the manager of its database of competition participants or its promoter for the management of its prospecting database.

The participant’s personal data will be kept for the entire duration of participation in the competition and then, after the end of the competition, for the time required to process any disputes and claims in accordance with the provisions of these terms and conditions. Except in the case where the participant has consented to receive communications from the Organising Body, his/her data will be deleted at the end of the period for processing disputes and claims.

In accordance with the applicable legislation, the participant has the right to access and rectify his/her personal data as well as, insofar as applicable, the right to request the deletion of his/her data, the right to object to the processing of his/her data and to obtain the limitation or portability thereof.

The Promoter will be collecting personal data of all entrants and holding the winner’s data on behalf of the Organising Body.

Liability

Bel UK may not incur any liability if, in the event of force majeure, events beyond its control or justified necessity, it is forced to shorten, extend, postpone, modify or cancel the competition.

Bel UK may not be held responsible for any event for which it is not responsible, in particular in the event of poor mail delivery, malfunctioning telephone lines, unavailability of the website, technical failures making it impossible to continue the competition, interruption of telephone communications, Internet network malfunctions preventing the proper conduct of the Game, interruptions, delays in data transmission, failures of the participant’s computer or any other problem related to the communication networks, servers, Internet access providers, computer equipment or software, the loss of any data, the consequences of any virus, anomaly, technical failure, any technical, hardware or software failure of any kind that prevents or limits the possibility of participating in the Contest or that damages a participant’s system, errors in the delivery of the prizes, the loss of the prizes during shipment, their non-receipt or deterioration, or their late delivery.

It is the responsibility of each participant to take all appropriate measures to protect his/her own data and/or software stored on his/her computer equipment against any attack. The participation in the competition is done under his or her sole and entire responsibility.

It is strictly forbidden, by any means whatsoever, to modify or attempt to modify the competition devices offered, in particular in order to modify the results or any element determining the outcome of a competition and the winners of a competition. Bel UK reserves the right to ensure equal opportunities among all participants, including through legal action or any other means at its discretion.

Bel UK reserves the right to exclude from the competition and to take legal action against any person who has attempted to cheat or disrupt the proper conduct of the competition. A winner who has cheated will be automatically stripped of any prize.

Bel UK shall in no case be held responsible for a malfunction or poor performance of the prizes offered. In particular, it cannot be held responsible for any positive case of Covid arising during or after the stay.

Bel UK is not responsible for the cancellation of the competition as a result of governmental measures against the Covid-19 pandemic, including travel restrictions or lockdown.

Fraud

Any fraud, or attempted fraud, manifested by a beginning of execution and committed with a view to unduly receive a prize, non-compliance with these rules, or any malicious intent to disrupt the running of the competition, will result in the exclusion of its author from the competition, with Bel UK reserving the right to initiate legal proceedings against the latter.

In the event of a claim in this respect, it is up to the participant to prove that he has behaved in accordance with these rules.

Complaints

No telephone enquiries will be answered concerning the terms and conditions of the competition, the determination of the winners and the interpretation or application of these rules.

Any claim must be made in writing and sent exclusively by post to BEL UK – 160 London Road, Sevenoaks, Kent, TN13 2JA, UK”and must include the exact references of the competition.

Written complaints and claims relating to the competition will not be taken into account after a period of three (3) months after the end of the competition, i.e. on 17th December 2021.

Settlement of disputes and governing law

These terms and conditions are governed by UK law.

In the event of disagreement on the application or interpretation of these rules, and failing an amicable agreement, recourse to alternative dispute resolution methods will be proposed. Failing this, any dispute shall be submitted to the competent court, in accordance with the legal rules of territorial jurisdiction or attribution.
